§1 Introductory Provisions

  1. NFC Juices online store, available at www.nfcjuices.com, is run by Gospodarstwo Sadownicze Zbigniew Pietrzycki, with its registered office in 05-660 Warka, Konary 92. The business activity is entered into the Central Register and Information on Business Activity (CEIDG), run by the minister responsible for economic affairs, NIP 797-127-18-11, REGON 672798121.
  2. These regulations are addressed to Customers and specify the rules and procedure for concluding a Distance Agreement with the Customer via the Online Store.
  3. The condition creating an Account and/or By placing an Order in the Online Store, you accept the provisions of the Regulations.
  4. All rights to the content provided by the Seller as part of the Online Store, in particular copyright to photos, the name of the Online Store, trademarks and graphic elements, software and rights in the scope of databases, are subject to legal protection and are vested in the Seller. It is prohibited to copy or otherwise use any elements of the Online Store without the consent of the Seller.

§2 Definitions

  1. Customer – a natural person, legal person or organizational unit concluding an agreement with the Seller within the Online Store and accepting the Regulations.
  2. Entrepreneur with Consumer Rights – a Customer who is a natural person concluding a Sales Agreement directly related to his/her business activity, when the content of the Sales Agreement indicates that it is not of a professional nature for this Entrepreneur, resulting in particular from the subject of the business activity performed by him/her, made available under the provisions on the Central Register and Information on Business Activity.
  3. Seller – a natural person conducting business activity under the name of Gospodarstwo Sadownicze Zbigniew Pietrzycki, entered into the Central Register and Information on Business Activity kept by the minister responsible for economic affairs, NIP 797-127-18-11, REGON 672798121.
  4. Online store – online service, available at www.nfcjuices.com, through which the Customer can place Orders and use other Electronic Services.
  5. Agreement – an agreement concluded with the Customer via the Online Store within the meaning of the provisions of the Civil Code, as part of an organized system for concluding distance contracts.
  6. Regulations – these Regulations of the NFCJuices Online Store.
  7. Order – a declaration of intent of the Customer aiming directly at concluding a Distance Sale Agreement for Products, submitted via the Online Store, specifying the type and number of Products ordered.
  8. Product – a movable item presented in the Online Store by the Seller, which may constitute the subject of an Agreement concluded with the Customer.
  9. Shopping Cart – an element of the Online Store software, in which the Products selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.
  10. Account – the Customer’s account in the Online Store, where data provided by the Customer and information about Orders placed by him are collected.
  11. Registration form – a form available in the Online Store enabling the creation of an Account.
  12. Order Form – an interactive form available in the Online Store, enabling the placement of an Order, in particular by adding Products to the Basket and specifying the terms of the Agreement, including the method of delivery and payment.
  13. Electronic Services – services provided electronically by the Seller to Customers, under the terms and conditions specified in the Regulations, via the Online Store.

§3 Contact with the store

§4 General information

  1. The Seller shall not be liable, to the fullest extent permitted by law, for any disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.
  2. Browsing the Store's assortment does not require creating an Account. The Customer may place orders for Products in the Store's assortment either after creating an Account or by providing the necessary personal and address data enabling the Order to be completed without creating an Account.

§5 Rights and obligations of the Client

  1. The Client is the only person authorized to perform operations on their Account. The Client is obliged to secure access to the Account, in particular not to transfer access data to the Account, including the password, to third parties.
  2. The Account contains information provided by the Customer during registration. After logging into the Account, the Customer has access to their data and the ability to modify it.
  3. The Customer is obliged to comply with the provisions of the Regulations and use the Online Store in a manner consistent with the provisions of applicable law and in a manner that does not disrupt its operation or make it difficult for other Customers to use it.
  4. The Customer is prohibited from placing illegal content in the Online Store, in particular content that: violates the law, is inappropriate for persons under 18 years of age, contains threats, incites aggression, is misleading, contains vulgarisms and phrases that may violate the dignity of third parties, promotes any websites, products, goods or services of third parties.
  5. During registration, the Client is obliged to provide true data.
  6. The Customer has the right to file a complaint related to the provision of Electronic Services by the Seller, which is precisely specified in paragraph 11 of these Regulations.

§6 Rights and obligations of the Seller

  1. As part of the provision of Electronic Services, the Seller ensures the technical efficiency and correct operation of the Online Store, in particular – enables Customers to place Orders.
  2. The Seller ensures the protection of electronic transmission by using technical and organizational measures to protect data against acquisition by unauthorized persons.
  3. If the Customer: has provided false data, has violated the personal rights of third parties, in particular the personal rights of other Customers, has engaged in behavior that is inconsistent with the Regulations or applicable legal provisions, the Seller may:
    1. call on the Client to cease the violations and remove their consequences,
    2. refuse to accept the Order or permanently delete the Account or temporarily block the Customer’s access to the Account – after an unsuccessful request to cease the infringement or to remove the effects of the infringement,
    3. in the event of posting content that violates legal regulations, provisions of the Regulations or good customs – suspend the publication of such content on the Online Store website, remove such content or block access to it.
    4. The Seller undertakes to properly execute Orders placed by Customers and to exercise due diligence when providing information.

§7 Rules for placing an order

  1. Information about the Products provided in the Online Store, in particular their descriptions, parameters and prices, do not constitute an offer within the meaning of the provisions of the Civil Code, but only an invitation to conclude an agreement within the meaning of Art. 71 of the Civil Code.
  2. Before placing an Order, the Customer should read the Product description available in the Online Store.
  3. The Customer may place Orders for Products available in the Online Store 24 hours a day, 7 days a week.
  4. Placing an Order does not require registration or creating an Account.
  5. To place an Order you must:
    1. enter the website www.nfcjuices.com,
    2. make a product selection,
    3. place an Order by taking subsequent technical steps based on the messages or information displayed to the Customer.
  6. After placing the Order, the Customer will receive an e-mail confirming receipt of the Order by the Seller.
  7. The Online Store employee may contact the Customer to confirm the content of the Order by phone. Upon receipt by the Customer of the e-mail message referred to in the above point, a Sales Agreement is concluded between the Customer and the Seller.
  8. If you notice any inaccuracies in the content of the message about receipt of the Order, please contact the Seller by phone or e-mail, sending a message to the following address: biuro@naszatlocznia.pl.
  9. The Seller attaches a receipt or VAT invoice to each Order, depending on the Customer’s preference.

§8 Payments

  1. The prices of Goods available in the Online Store are given in Polish currency and are gross prices (i.e. they include VAT).
  2. The prices of the Goods do not include delivery costs (if applicable), which are indicated each time in the process of placing an Order. The total value of the Order includes the price of the ordered Products and delivery costs.
  3. The Customer may choose one of the available payment methods: bank transfer, mobile payments via a payment intermediary service indicated on the Online Store website (imoje payments, handled by ING Bank Śląski SA with its registered office in Katowice, Przelewy24 payments handled by PayPro SA), cash on delivery or cash/card payment in the case of personal collection.
  4. In case of payment by bank transfer, please provide the Order number in the title.
  5. In the case of payment by bank transfer or mobile payment, the Customer is obliged to make the payment within 48 hours from the moment of placing the Order, otherwise the Order may be canceled, about which the Customer will be immediately informed by the Online Store staff.
  6. In case of cash on delivery the Customer is obliged to collect the shipment and pay the entire amount of the order upon delivery. Otherwise, the Seller may charge the Customer for shipping costs and the return of the uncollected Order.

§9 Delivery

  1. Delivery of the placed Order to the Customer is subject to payment in accordance with the delivery terms offered by the Seller, which are communicated when placing the Order.
  2. The Seller provides information about the shipping cost when placing the Order, at the time of selecting the shipping method.
  3. Delivery of the placed Order is possible only through entities cooperating with the Seller.
  4. In the case of delivery of the Order outside the territory of the Republic of Poland, the delivery costs may differ from those given. In the case of the wish to place an Order with delivery Outside the territory of the Republic of Poland, please send an inquiry by e-mail to biuro@naszatlocznia.pl
  5. Delivery time depends on the date of placing the Order. Products are sent to the Customer immediately after receiving payment or in the case of payment on delivery - immediately after placing the Order, taking into account weekends and non-working days.
  6. In the event of ordering Products with different readiness for collection dates, the readiness for collection date is the longest date given.
  7. The Seller must execute the Sales Agreement no later than thirty days after its conclusion.
  8. When receiving the shipment, the Customer should carefully check it to determine whether the shipment has not been damaged during transport and whether its contents are consistent with the Order.
  9. In the event of any irregularities, the carrier should be requested to prepare a damage report and the event should be reported to the Seller immediately.

§10 Right to withdraw from the Agreement

  1. The Customer (Consumer and Entrepreneur with Consumer Rights) may withdraw from the Agreement within 14 days without giving any reason.
  2. The period specified in point 1 starts from the date of delivery of the Product to the Customer.
  3. In the case of a Contract covering multiple Products that are delivered separately, in batches or in parts, the period indicated in point 1 shall run from the delivery of the last item, batch or part.
  4. The Customer may withdraw from the Agreement by submitting to the Seller a completed and signed declaration of withdrawal from the Agreement (Return of Goods Form available for download below). To meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send the declaration before the deadline expires.
  5. The declaration may be sent by traditional mail or electronically. It should include the Customer's data, order number, sales document number, indication of the returned Product and optionally the reason for the return.
  6. The returned product must reach the Seller in pristine condition, showing no signs of use along with the purchase confirmation – a receipt or VAT invoice, completed and signed return form. Returns without a sales document or returns form will not be processed.
  7. The costs of delivering the returned Product to the Seller are borne by the Customer.
  8. Cash on delivery parcels will not be accepted.
  9. The Seller will refund the payment using the same payment methods that were used by the Customer in the original transaction, unless the Customer has expressly agreed to another solution that will not involve any costs for him.
  10. The Seller will refund the payment within 14 days from the moment the return is confirmed, i.e. the product does not bear any traces of use and the return contains all the required documents specified in point 6 of this paragraph.

§11 Complaint

  1. The Seller is responsible for the proper quality of the Products sold.
  2. Any complaints may be submitted within a maximum of 14 days from the moment the Customer notices any irregularities related to the Order or Product.
  3. The Customer (Consumer and Entrepreneur with Consumer Rights) may file a complaint by submitting a complaint statement (Product Complaint Form available for download below).
  4. The complaint statement may be submitted via traditional mail or electronically.
  5. The product subject to complaint should be delivered together with confirmation of purchase and a completed and signed complaint form.
  6. The costs of returning the complained Product are borne by the Seller by providing the Customer with a shipping label.
  7. Cash on delivery parcels will not be accepted.
  8. Complaints will be considered by the Seller within 14 days of receipt of the product.

§12 Personal data protection

  1. The administrator of Customers' personal data collected via the Online Store is the Seller.
  2. Personal data of Customers collected by the administrator via the Online Store are collected for the purpose of implementing the Agreement and, if the Customer consents, also for marketing purposes.
  3. The recipients of the personal data of Customers of the Online Store may be:
    1. In the case of a Customer who uses the Online Store's delivery method by post or courier, the Seller makes the collected personal data of the Customer available to the selected carrier or intermediary carrying out the shipment.
    2. In the case of a Customer who uses electronic payment in the Online Store, the Seller makes the collected personal data of the Customer available to the selected entity handling the above payments in the Online Store.
  4. The customer has the right to access and correct their data.
  5. Providing personal data is voluntary, however, failure to provide the personal data specified in the Regulations and required to conclude the Agreement results in the inability to conclude the Agreement.

§13 Final provisions

  1. Agreements concluded via the Online Store are concluded in Polish.
  2. The Seller reserves the right to make changes to the Regulations for important reasons, i.e. changes in legal regulations, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. The Customer will be informed of each change by the Seller.
  3. In matters not regulated in these Regulations, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the provision of services by electronic means; the Act on consumer rights, the Act on the protection of personal data.
  4. The customer has the right to use out-of-court methods of settling complaints and pursuing claims.
  5. The regulations enter into force on 05/07/2018.
